Who we are

AB Mortgages is a trading style of Ashley Bennett Mortgages Ltd, registered in England and Wales under company number 13144797. Our registered office is 105 London Road, Benfleet, Essex, SS7 5TG. Ashley Bennett Mortgages Ltd is an Appointed Representative of Stonebridge Mortgage Solutions Ltd, which is authorised and regulated by the Financial Conduct Authority. We are entered on the Financial Services Register under FCA number 946267.

Where your enquiry relates to commercial, bridging or other business finance that is not regulated by the Financial Conduct Authority, it may be handled by AB Specialist Finance, which is an Appointed Representative of Connect IFA Ltd, authorised and regulated by the Financial Conduct Authority under FCA number 441505.

We are the data controller for the personal information collected through this website and in the course of providing our services. Our Data Protection Lead is responsible for our data protection compliance programme and can be contacted at info@abmortgages.co.uk or by calling 0333 339 0440. We handle all personal data in line with the UK General Data Protection Regulation and the Data Protection Act 2018.

The information we collect

Depending on the service you ask us for, we may collect identity information such as your name, date of birth, marital status and nationality; contact information such as your address, email address and phone numbers; financial information such as your income, outgoings, employment details, bank statements, existing mortgage and credit commitments and credit history; details of the property or transaction we are advising on; records of our communications with you, including recorded calls; technical information about how you use this website, such as your IP address and browser type; and your marketing preferences.

Because we arrange protection products such as life insurance, critical illness cover and income protection, we may also need to collect health information. This is special category data, and we will only collect and use it where it is necessary for the product you have asked about and with your explicit consent.

How we collect your information

Most of the information we hold comes directly from you, through the forms on this website, fact finds, phone calls, emails, messages and meetings, and the documents you provide. With your permission, we may also collect information from credit reference agencies and open banking providers, and we receive information from lenders, insurers and other parties involved in your application. Some technical information is collected automatically when you use this website, as explained in our Cookie Policy.

How we use your information

We use your information to provide advice and to research, recommend and arrange mortgages, finance and insurance on your behalf, which is necessary to perform our contract with you. We use it to respond to enquiries you send us and to manage our relationship with you, based on our legitimate interests in running our business. We use it to meet our legal and regulatory obligations, including the rules of the Financial Conduct Authority, anti-money laundering and fraud prevention checks, complaint handling and record keeping. We may also use your contact details to send you relevant updates and marketing where you have agreed to receive them or where we have an existing client relationship with you, and you can opt out at any time.

We do not make decisions about you using solely automated processing, and we do not sell your personal information.

Who we share your information with

To provide our services we share relevant information with our network principals, Stonebridge Mortgage Solutions Ltd and, for specialist finance business, Connect IFA Ltd; with the lenders, banks and insurers you apply to; with credit reference agencies; and with the solicitors, conveyancers, estate agents and other professionals involved in your transaction where this is needed to progress your case. We also use carefully selected suppliers who process information on our behalf, such as our customer relationship management system and IT providers, and we may be required to share information with regulators such as the Financial Conduct Authority or the Information Commissioner's Office, or where the law otherwise requires it.

International transfers

Some of the suppliers and support services we use, including our customer relationship management system and administrative support, are based outside the UK. Where your personal data is transferred outside the UK, we make sure it receives an equivalent level of protection, for example by using the UK International Data Transfer Agreement or the UK Addendum to the European Commission's Standard Contractual Clauses, or by transferring to countries covered by UK adequacy regulations.

How long we keep your information

We keep personal information only for as long as it is needed. Client files are generally kept for at least six years after our relationship ends, in line with our regulatory obligations and the Limitation Act 1980, and some mortgage and insurance records are kept for longer where the rules require it. Information used for marketing is kept until you opt out or it is no longer needed. We review the information we hold regularly and securely delete anything we no longer need.

How we keep your information secure

We use appropriate technical and organisational measures to protect your information against loss, misuse and unauthorised access. Access is limited to the people who need it to do their jobs, and everyone who handles personal data on our behalf is bound by obligations of confidentiality. If we ever identified a breach likely to put your rights at risk, we would notify you and the Information Commissioner's Office in line with our legal duties.

Your rights

You have the right to be informed about how your information is used, to access the information we hold about you, to have inaccurate or incomplete information corrected, to ask for your information to be deleted where there is no good reason for us to keep it, to restrict or object to our processing, including for direct marketing, to receive a copy of information you have provided in a portable format, and to withdraw any consent you have given at any time.

To exercise any of these rights, email info@abmortgages.co.uk with the subject line Subject Access Request, or write to us at our registered office. We may need to confirm your identity before we respond. There is no charge, and we will respond within one month unless your request is particularly complex, in which case we will let you know.

Complaints

If you are unhappy with how we have handled your information, please contact us first at info@abmortgages.co.uk and we will do our best to put things right. You also have the right to complain to the Information Commissioner's Office at any time by visiting ico.org.uk or calling 0303 123 1113.
